Acceptance
By creating an account or using maturityOS, you agree to these terms on behalf of yourself and the organization you represent.
Subscription
Subscriptions are billed per seat, per month or per year, and renew automatically until cancelled. Cancellations take effect at the end of the current billing period.
Acceptable use
Don't reverse-engineer, resell, or use the platform to assess organizations you have no authorization to assess. Don't use it to surveil individual respondents.
Intellectual property
The Holistic Maturity Model, the platform, and the maturityOS marks are owned by maturityOS. Customer data and customer-generated reports remain owned by the customer.
Confidentiality
Each party will protect the other's confidential information with the same care it uses for its own, and at minimum reasonable care.
Service levels
We target 99.9% monthly availability for the production application. Specific commitments and remedies for enterprise plans are documented in an order form.
Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages. Aggregate liability is capped at fees paid in the prior twelve months.
Termination
Either party may terminate for material breach uncured after thirty days' notice. On termination, customer data is exported on request and then deleted within thirty days.
Governing law
These terms are governed by the laws of the jurisdiction stated in the order form, and disputes are resolved in the courts of that jurisdiction.
